Prince Edward County’s council voted to reject a proposal for a battery storage facility last week, responding to citizen concerns about safety and risk to the environment.

A Battery Energy Storage System or BESS was proposed by Compass Energy, a 250-megawatt facility that would require 15 acres of land.

Ontario’s Independent Electricity System Operator or IESO currently has a Request for Proposals for new power sources; the IESO is looking for 1,500 megawatts of power which can include new projects such as natural gas or wind, and battery storage. The proviso is that the power must be available immediately, and “can deliver a continuous amount of electricity to a connection point on a distribution system or transmission system for at least four consecutive hours,” according to the IESO website.

The Alliance to Protect Prince Edward County or APPEC* made a presentation to council with their concerns about the proposal.

“When we first became aware of the Picton BESS proposal a few months ago, we thought the scale of the project warranted evaluation,” says APPEC president and County resident Orville Walsh.

“We anticipated that [the proponents’] community meeting in early December would provide many of the project details. That turned out not to be the case. According to the project website, they will only be designing or planning the project after obtaining a contract from the IESO.”

Walsh told Prince Edward County Council that on investigation of available information about the project, APPEC concluded that there is no information on the type of equipment that will be used, battery manufacturer, or other electrical components; no information on the HVAC systems to be utilized; no information on fire detection systems, fire suppression systems and equipment; and no noise studies or estimates of environmental noise, which can be significant.

“We can only imagine the noise that could be generated on a warm summer night by 250 HVAC units,” Walsh told Council.

There are few specifics about this project, Walsh explained, “not a single drawing or illustration that is reflective of the scale of the project.  

“Giving support to a project lacking basic information is like buying a pig in a poke,” he said.

Residents of The County were also concerned about the loss of prime agricultural land to the power project, which contravened both the Ontario government’s statements and requirements of the local Official Plan to preserve valuable farmland.

Fire a significant risk

The danger of fire is an “unacceptable risk” from the lithium-ion batteries, say residents. Quoted in a report in the Picton Gazette, resident “Don Wilford spoke to council detailing the environmental devastation that would occur should a fire break out at a 250 megawatt BESS along with the immediate risk to the local population. ‘Lithium-ion batteries are susceptible to fires. At the scale proposed, the fire would cause vast damage to wetlands, the toxic gas plume requiring evacuation of Picton only 5 km away and potential loss of firefighters’ lives,’ Wilford stated.”

Others wondered why the Prince Edward County location was chosen as it is not near major population centres, or power generation facilities. (We can tell you: willing landowners, nothing else.)

Company competence in battery storage

Citizens also noted that the proponent had no experience with battery storage facility construction or operation. Resident Don Wilford presented background information about proponent Compass Energy: it is owned by Irving, which in turn is a subsidiary of Icon Infrastructure, a financial investment firm based in the U.K., he said.

“None of these companies have experience with battery storage,” said Wilford. “It appears Ontario is not only ignoring safer zinc battery tech but outsourcing a key component of its electricity infrastructure to financial companies that will outsource the tech to a systems integrator, which will, in turn, repackage lithium-ion units from major suppliers in China.”

It was also noted that the developer admitted there would be “zero” long term employment opportunities for people in Prince Edward County.

Valuable farmland would be lost

Sophiasburgh Councillor Bill Roberts tabled an amendment to deny the request from Compass Energy, listing all the concerns expressed by community members, adding that the Prince Edward Federation of Agriculture was also no in favour of the project.

“I’m opposed to the use of prime agricultural land for this purpose,” he said according to the story in the Picton Gazette.  “I support the Prince Edward Federation of Agriculture in their opposition to non-agricultural development on prime farmland. I hear convincing and alerting information from the audience,” said Roberts.

Roberts repeated the concerns about the risk of fire: “I find the potential fire and contamination risks compelling. Since 2017 there have been 50 such failures including five at large BESS installations. One in Australia required 150 firefighters and four days to extinguish,” decried Roberts. “I don’t get a sense the proponents have the experience to complete and operate such a giant BESS project. I was particularly struck by the IESO’s own connection site identification, wherein at least 166 sites were deemed preferable.”

Roberts amended motion was seconded by councillor John Hirsch and passed by council.

Battery storage proposals are popping up in various locations throughout the province, with varying degrees of success.

Other projects proposed include solar power facilities. One developer put forward a proposal to the council in Sault Ste Marie but declined to tell the elected representatives where the project might actually be located. At another meeting, the proponent claimed full support by local indigenous communities, which turned out not to be true: there had been some conversations including email exchanges, but there had been no formal expression of support.

In the U.S., energy commentator Robert Bryce says that community opposition to large wind and solar power projects is rising; people understand that wind and solar (and now, battery storage) do little to help the environment or alter climate change, but they do have significant environmental impacts, and cause electricity bills to rise. Bryce maintains a database of community rejections of large renewable energy projects.

Comment: frankly, we cannot understand why any company would want to take on the folks in Prince Edward County. They spent more than 10 years, and more than $1.5 million after-tax dollars to defend the County against four wind power projects, all of which would have endangered wildlife, wetlands, and the fragile topography of the area, as well as having a negative impact on tourism, for which the area is rightly famous.

Contrast between North Stormont and Prince Edward County an indication of Ontario’s muddled electricity file

While people in Prince Edward County are celebrating the demise of the “White Pines” wind power project as government-ordered decommissioning of the industrial-scale wind turbines is going on this week, the people of North Stormont, south-east of Ottawa, are watching the behemoths go UP.

The White Pines project in Prince Edward County, developed by Germany-based wpd, was a controversial power project appealed several times by residents concerned about the environmental impact of the wind power generators and infrastructure on wildlife and people. The original plan was for 29 turbines; that was reduced to 27 after legal action and finally, to nine.

The new Ontario government passed legislation not long after taking office cancelling the power project — residents say it should never have been approved in the first place.

But now, more than 30 giant grid-scale wind turbines are currently being erected in North Stormont, near the communities of Finch, Crysler and Berwick by Portugal-based power developer EDPR. EDPR sold the project last year to Axium Infrastructure; that consortium also owns the K2 Wind power project in Huron County, which has been the subject of appeals, and post-operation, hundreds of noise complaints.

K2 Wind is currently under order by the Director of the environment ministry to implement and evaluate a noise assessment plan for more than 80 of its 140 turbines, which were found to be out of compliance with Ontario regulations for wind turbine noise emissions.

“Nation Rise” as the North Stormont project is called, was also the subject of appeals, and a last appeal was submitted to the Ontario environment minister six months ago. No word on the status of the appeal, nor on the status of a request for a stay of construction, filed in May.

Residents are concerned not only about noise (the project got to use old, pre-2017 noise assessment rules under the Wynne government), and also damage to the environment, especially a fragile or “vulnerable” water table.

The Nation Rise final approval came through days before the provincial election in 2018, despite the “caretaker” government convention which discourages major decisions during the election period. The Independent Electricity System Operator (IESO) also granted a Notice To Proceed days after the election, despite being warned by government leader MPP Todd Smith not to approve any more projects.

Now, the giant towers are rising in the quiet communities of North Stormont, as the power developer races to meet a December operational deadline. The local MPP Jim McDonell claims there’s nothing he can do about it—that Notice To Proceed meant the project had to go ahead.

Pre-construction liability for Nation Rise (i.e., the cost of the government cancelling the contract) was about $400,000. If it goes into operation, the people of Ontario will bear the cost of the project which will add more than $400 million to electricity bills, over the 20-year life of the power contract.

So, while the turbines go up, others — already approved and built — come down. And you’re paying for it all.

Landmark legal decision overturns government approval of large power project

WELLINGTON, ONTARIO, CANADA, April 27, 2017 /EINPresswire.com/ —
A years-long legal battle over a wind power project by Germany-based wpd in Ontario, Canada, resulted in a ruling by the provincial government’s Environmental Review Tribunal yesterday, in favour of protecting an endangered species of turtle.

In the Tribunal ruling, government approval for 18 of 29 industrial-scale wind turbines in the “White Pines” project was reversed. With 60 percent of the project removed, it may be impossible for the power developer to meet its contractual obligation.

The citizens of Prince Edward County, about two hours east of Toronto, where the project was to be located, fought the wind turbines for almost 10 years, and spent almost $2 million CAD in legal fees.

“The County” as it is called, on the shores of Lake Ontario, is a stopping place for hundreds of thousands of birds migrating in eastern North America, and was identified as an Important Bird Area by conservation groups. The area is also a habitat for the endangered Blandings turtle, and home to the Little Brown Bat which is on the verge of extirpation.

“This [decision] is clearly a victory for the survival of the Blanding’s turtle and many other animal and plant species,” said Alliance to Protect Prince Edward County president Gordon Gibbins. “Although the Tribunal decision was specifically concerned with protecting the turtles and their habitat, we are very pleased that indirectly as a result of this decision there will be no turbines in the Prince Edward County Important Bird and Biodiversity Area.”

“The Tribunal decision has made it clear that this wind power project was never about protecting the environment,” said Jane Wilson, president of Wind Concerns Ontario, the coalition of community groups concerned about wind power projects.

“The wind power project was always about money. The citizens of Prince Edward County fought hard to protect the environment and wildlife against our own Ministry of the Environment.”

Citizen evidence was crucial in bringing forward evidence of harm to the environment in the various appeals of the power project, Wilson says. “The government did little or no oversight on how wildlife is to be protected, and it was the people of Prince Edward County who brought the information to the Tribunal. As a result, in Ontario now, wind power does not automatically override environmental concerns.”

Economic impacts were also a concern for the community. The County is a tourist destination with dozens of wineries and cheese establishments; winery owners were concerned about the negative impact of the huge power-generating turbines on the County with its quaint villages and pastoral views as a tourist attraction.

Prince Edward County Mayor Robert Quaiff said, “Our community has been fighting this project for quite some time. I’m glad to see that the Environmental Review Tribunal has recognized and given credence to our concerns.”

Minutes before 4 PM on the Thursday of the Easter weekend, Germany-based wind power developer WPD issued notice to the Environmental Review Tribunal that the company intends to start clearing land in advance of building the White Pines power project.

Land clearing is to begin on Wednesday, the corporate power developer said, which meant there is only one day after the Easter weekend to file any documents against the action.

The White Pines project has been contested in an appeal before the Tribunal; the original decision found that the power project would cause harm to endangered species of turtles and bats. A hearing was held in late January to hear possible “remedy” actions to prevent loss of life, but a decision accepting or rejecting the remedies has not yet been rendered.

WPD is in danger of being in breach of its contract with the Ontario government if it does not begin supplying power by the critical Commercial Operation Date.

The Blandings Turtle, one of the endangered species at risk from the wind power project construction, has already been seen in the County by residents, so has emerged from hibernation.

The rush to construction shows how willing the wind power developer is to risk environmental damage, a spokesperson for the Alliance to Protect Prince Edward County told news media Quinte News.

At an earlier phase of the White Pines project WPD began unauthorized land clearing but was halted by an order from the Environmental Review Tribunal. WPD is also the power developer behind the contentious Fairview Wind project near Collingwood. It threatened to sue the Ontario government if a contract was not issued for the power project.

Picton barge incident highlights wind developer attitude to environment

The recent sinking of a commercial barge near Picton, Ontario, in Prince Edward County, has resulted in a spotlight on the activities by wind power developer Algonquin Power, and its controversial Windlectric project on Amherst Island.

The project will virtually subsume the little island, which is home to 34 at-risk or endangered species of wildlife, and change life for its residents dramatically. However, that wasn’t enough to sway the Environmental Review Tribunal, which dismissed a citizen group appeal. The project is still before the courts, with a new phase beginning in Toronto this week, before Divisional Court.

One of the requirements in a power developer’s Renewable Energy Approval or REA is a marine logistics plan, which documents how marine safety will be managed as construction proceeds, and equipment and material such as gravel are transported over water.

Windlectric had no Marine Logistics Plan in place.

Until the day after the barge sank.

The barge was to transport gravel from Prince Edward County across the water to the Windlectric site but encountered ice which “sandpapered” a two-foot by two-foot hole in the hull, and partially sank.

Windlectric hastily issued a Marine Logistics Plan which, interestingly, made no mention whatsoever of the use of Picton Bay, and how the barge traffic was going to work with the Glenora Ferry trips every 15 minutes. Picton elected officials also expressed surprise at the use of the Picton Terminal: they had no idea that Algonquin Power was getting gravel from Prince Edward County, and there had been no agreements for road use.

Use of the Picton facility has now been halted, and Prince Edward County remains under a Boil Water advisory due to the spill of diesel fuel, although the state of emergency has been revised from earlier this week.

This weekend, the power developer issued a statement saying the barge sinking was “unfortunate” but “outside the project’s boundary at the time of the event.” So, not our concern.

Algonquin Power is also seeking the use of a stretch of parkland near Millhaven and Bath to use as a construction staging area; the company claims it will return the parkland to its original state after it is finished.

The fact remains that the construction of wind “farms” is actually construction of huge power plants, no matter what bucolic photos of benign “windmills” are used.

Questions should be raised about the environmental impact of these construction activities not only of the developers but also the Ontario Ministry of the Environment and Climate Change, which citizens have a right to expect is overseeing events and confirming that mandated conditions for environmental protection and safety are being met.

A barge carrying construction materials to the Windlectric wind farm site on nearby Amherst Island sank this past weekend, polluting Picton Bay with diesel fuel. The bay is the source of drinking water for Picton; at the time of the incident, the wind power company had not yet filed a mandatory Marine Logistic Plan to document safety measures.

The Amherst Island group says in light of violations of terms of the power developer’s agreement with the government, the project –which will cost Ontario electricity customers $500 million over 20 years–should be cancelled.

Dear Premier Wynne

Prince Edward County Mayor Robert Quaiff has declared a water emergency as a result of contaminants approaching the Picton-Bloomfield water intake due to a partially sunken barge in Picton Harbour under contract to McNeil Marine and ultimately under contract to Algonquin Power/Windlectric for the proposed Amherst Island Wind Project.
The silence from Algonquin Power/Windlectric is deafening.
Indeed Algonquin/Windlectric had the audacity to attempt to continue aggregate delivery from Picton Terminals to Amherst Island yesterday (Tuesday March 28 2017) but was thwarted either because either the water was too low or the dock too high, yet another example of the comedy of errors associated with this ill-conceived project.
The Association to Protect Amherst Island reiterates its request for MOECC to issue an immediate stop work order for the Amherst Island Wind Project until such time as a comprehensive report is available for the Picton Harbour incident and a preventative action plan is is place to address the high risk to public and environmental safety of all aspects of the project. and to address the need for a Major Design Modification to address the changed project location to include Picton Terminals.
 
At the same time, the Association reaffirms its request to reject the proposed amendment to the Certificate of Property Use for the contaminated  Invista Lands on Bath Road (EBR 012-9749) designated as parkland.  Similar to the Picton Harbour situation, a water intake exists in proximity to the proposed mainland dock for the Amherst Island Wind Project and serves a local industrial park.  Algonquin/Windlectric in its Marine Safety Plan now advises that fuelling of barges is proposed at the mainland dock location.  Not only is the land contaminated with the possibility of pollution of Lake Ontario, the company plans to fuel in proximity to a water intake.

The same “Marine Safety Plan” fails to address any aspect of transport of materials from Picton terminals except for a vague reference that “The bulk barge and the ATV (Aggregate Transfer Vessel)  will approach and leave the island dock area from the west, . . . ” as if from the Land of Oz.  The Association is in the process of reviewing this “too little, too late” document and will have further comments about use of barges in ice conditions, the lack of traffic volume, lack of simulation of barges crossing the ferry path, incomplete information about the installation of the high voltage transmission line from the mainland to the Island and the total lack of risk assessment, failure to mention Picton Terminals,among other matters.

The use of an “Aggregate Transfer Vessel” was not identified in the REA submission and no stockpiling of aggregate was proposed other than in immediate proximity to the proposed cement batching plant by the Island school.
The Association has emphasized the importance of marine safety since this project was proposed and has pleaded with politicians, MOECC, Ontario’s Chief Drinking Water Official and the Chief Fire Marshall and Head of Emergency Preparedness.
Please take immediate action to stop the Amherst Island Wind Project before a tragedy occurs.

Wynne government should cancel wind power contracts for hydro bill relief, says WCO

“Poverty is getting worse in Ontario,” says Wind Concerns Ontario president

 

Wind Concerns Ontario welcomes the acknowledgement by Premier Kathleen Wynne of financial hardship imposed by her government’s energy policies, and has sent six recommendations for action that will provide immediate relief.

“We know that energy poverty in Ontario is real and worsening under this government,” says WCO president Jane Wilson. “Hundreds of thousands of people are having difficulty paying their electricity bills, and many are having to choose between ‘heat and eat.’ Meanwhile, corporate power developers are getting paid huge profits in Ontario – this has to change, now.”

Wind Concerns Ontario sent the Premier a list of recommendations: 

  1. Immediately cancel LRP II renewable power program. Currently “suspended,” its target was to acquire 1,000 megawatts (MW) of power, even though the government says we have a “robust” supply of power for the future. The cost of this new capacity would go straight to Ontario’s electricity bills
  2. Cancel the five wind power contracts awarded under LRP I for 299 MW. This action will save ratepayers about $65 million annually and $1.3 billion over 20 years. Cancellation costs will amount to a small fraction of the annual cost, probably on the order of about $2 million, at most. In addition, cancelling approved but not yet built wind power projects, and the new FIT 5.0 program will also save money. Together, these cancellations can save ratepayers from future rate increases of nearly $4 per month.
  3. Cancel “conservation” spending of $400 million annually. This action would have an immediate effect on ratepayers’ bills, reducing them by $5.50 per month or about $70 a year. Ontario’s ratepayers have already reduced their consumption from 157 TWh in 2005 to 137 TWh in 2015, for a significant 12.7% decrease.
  4. Allocate the Ontario Electricity Support Program (OESP) to the Ministry of Community and Social Services. The OESP is essentially a social assistance program and it is questionable as to whether ratepayers should bear the burden of its costs. With an estimated annual cost of $200 million, the effect of this would be an immediate savings of about $4 per month on ratepayers’ bills, and an annual savings of $50. We recognize, however, that the move would impact the budgetary shortfall by a like amount so we recommend the following action.
  5. Levy a tax on wind and solar power generation on a per-megawatt basis starting at $10 per/MWh. This would result in raising sufficient revenues to offset the OESP costs. The effective rate could be held at that level or increased in the event the OESP costs exceed the forecast $200 million per annum. The Auditor General previously reported the award value per MWh of the 20-year contracts to wind and solar power developers exceeded those in other jurisdictions by a considerable margin. The tax would serve as a recognition of those excessive margins. (Note: the wind power contracts also contain cost of living increases of up to 20% over the term of the contracts.)
  6. Immediately reduce the Time of Use (TOU) off-peak rate. We recommend an immediate reduction in the TOU off-peak rate from 8.7 cents/kWh to 7.4 cents/kWh to encourage the shift of power consumption from peak to off-peak time in order to flatten daily demand.

“Poverty is a major factor in population health,” says Wilson, a Registered Nurse. “It is time Ontario takes action to help people now, and not cause further hardship for Ontario families.”

OTTAWA WIND CONCERNS NOTE: The contract for the “Nation Rise” wind power project in North Stormont, just south-east of Ottawa, will cost Ontario residents $430 million over its 20-year contract, for intermittent wind power we don’t need. Cancelling the power project, slated to be 100 megawatts and over 30 industrial-scale wind turbines, would cost no more than $600,000. Other projects in our area would be the much-contested Amherst Island project which will endanger birds and other wildlife species, and the White Pines project in Prince Edward County, also a danger to migratory birds and other wildlife. Cancelling these projects which are not yet built will save millions.

Wind turbines do not trump natural environment, Tribunal says

The long awaited decision of the Environmental review Tribunal on the appeal of a proposed wind power project at Ostrander Point in Prince Edward County was released yesterday. The Tribunal says that due to the clear danger to endangered species, the proposed project — approved by the Ontario government — is “not consistent” with the goals of renewable energy policy.

PRINCE EDWARD COUNTY – It appears the gates to Ostrander Point are closed and there will be no turbines allowed entry.
An Environmental Review Tribunal (ERT) issued it’s ruling early Monday, upholding an appeal of the nine-turbine project by the Prince Edward County Field Naturalists (PECFN), saying the installation of gates on access roads won’t adequately protect the population or habitat of Blanding’s turtles.
In their decision, ERT members Heather Gibbs and Robert Wright found “the remedies proposed by Ostrander [Gilead] and the Director are not appropriate in the unique circumstances of this case. The Tribunal finds that the appropriate remedy under s.145.2.1 (4) is to revoke the Director’s decision to issue the REA [Renewable Energy Approval].”
The issue has raged on since Gilead Power received their Renewable Energy Approval (REA) in 2012 It was almost immediately appealed by PECFN. Another appeal by the Alliance to Protect Prince Edward County, based on potential harm to humans was dismissed by the ERT
“We feel so vindicated with the decision,” said PECFN president Myrna Wood shortly after news of the decision was received. “Especially since the Tribunal said it understands how important renewable energy is to the future, but it cannot override harm to the species and their habitat.”
In 2013, the ERT upheld the PECFN appeal of the REA to Gilead Power — the first time an appeal of an REA under Ontario’s 2009 Green Energy laws had been successful. A year later, an Ontario Court reversed the ERT decision, only to see the Court of Appeal side with the PECFN earlier this year, but did allow for Gilead to propose remedial action to circumvent environmental damage.
“Our south shore is so important to so many species and that environment simply cannot be destroyed for the development of renewable energy,” she said. “We were the first appeal on environmental grounds and I think that will likely have an effect going forward and I would think that’s why we were fought so hard by the Ministry of Environment.”
The project would require the construction of more than five kilometres of access roads to construct and service the nine turbines and as part of the remedy, Gilead proposed to reduce traffic by installing gates
Wood said she wasn’t certain if there was another step Gilead Power could take following Monday’s decision.  …

April 6, 2016, Picton, Ontario —STATEMENT FROM ALLIANCE TO PROTECT PRINCE EDWARD COUNTY (APPEC)

First and foremost our great thanks to everyone who responded to our call to attend the Court of Appeal hearing.  The courtroom was filled to capacity with no seats left empty.  The numbers left an impression on all present from the judge to the security guards who were curious about what case all the commotion was about.  It was a packed courtroom by anyones’ standards and we thank all of you who made this possible.  Our special thanks to Mayor Quaiff and Warren Howard of Wind Concerns Ontario.
However the outcome of today’s hearing is not what we had hoped for.  On our arrival we had hoped that Justice Katherine van Rensburg would hear our appeal and our new evidence including aerial photography of the destruction that has occurred at the White Pines project site since WPD began clearing vegetation two days ago, as depicted in one photograph attached.
Instead Sylvia Davis, lawyer for the Ministry of the Environment and Climate Change, cited a ruling from over fifty years ago that only a panel of three judges could hear an appeal of this nature.  It became clear at that point that the motion would not be heard until after the legal matter of whether this was properly before the court had been dealt with, with a potentially unfavourable decision. Rather than spend considerable time and money on legal wrangling the decision was made to withdraw our motion for a stay on all physical activity at the White Pines project site.  The motion was withdrawn on consent of all parties and without costs.
We have received the written reasons from the Environmental Review Tribunal for its original refusal of our stay motion.  We will immediately be going to the Tribunal to once again request a stay.  As the saying goes when one door closes, another opens.  More information will follow soon.

Wind farm will cause serious irreversible harm to wildlife, Tribunal finds

The decision on the appeal of the White Pines wind power project in Prince Edward County was released yesterday: the Environmental Review Tribunal found for the appellant and the environment (in part), in that serious and irreversible harm would result to the endangered Blandings turtle and the little brown bat. The Tribunal also noted risk to migratory birds.This is a victory for a very hard-fought battle as members of this community fought to save the environment from Ontario’s own Ministry of the Environment.

Statement from Orville Walsh, president of the Alliance to Protect Prince Edward County:

We are pleased to announce that APPEC’s appeal of wpd’s White Pines Wind Project has been upheld in part.  The Tribunal has found that the White Pines project will cause serious and irreversible harm to Little Brown Bats and to the Blanding’s turtle.
The Tribunal did not find serious and irreversible harm to human health, to hydrology or to migratory birds. However in regards to the latter the Tribunal did note that this wind project presents a significant risk of serious harm to migrating birds and that the project site was poorly chosen from a migratory bird perspective.
We are cautiously elated!  The Tribunal acknowledges that engaging in this wind project in accordance with the REA (Renewable Energy Approval) will cause serious and irreversible harm to animal life.  Therefore wpd no longer has an REA to stand behind.
The ERT has ordered a hearing of submissions with respect to potential remedies.
The board will be studying the decision over the weekend and following consultation with our legal counsel Eric Gillespie, will have more information to give you next week.
